If you are using the Services on behalf of an organization, you are agreeing to these Terms for that organization and representing that you have the authority to bind that organization to these Terms. Club de Padel reserves the right to modify or revise these Terms at any time, in its sole discretion. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Website or Services after any such changes constitutes your acceptance of the new Terms. You are advised to review these Terms periodically for any changes.
3. Eligibility
You must be at least 13 years old to use our Services. By using the Services, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into a binding agreement.
4. Account Registration
To access certain features of the Website and Services, you may be required to register for an account. When registering, you agree to:
Club de Padel reserves the right to suspend or terminate your account and refuse any and all current or future use of the Services if you provide any information that is untrue, inaccurate, not current, or incomplete, or if Club de Padel has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete.
5. Booking and Payments
All padel court bookings are subject to availability and Club de Padel's booking policies, which may be updated from time to time. You agree to abide by all booking rules, including cancellation policies and no-show fees, as communicated during the booking process.
Membership benefits, terms, and conditions are outlined separately in the Club de Padel Membership Agreement, which will be provided to you upon membership registration.
All payments for bookings, memberships, and other services must be made through the payment methods provided on the Website. You agree to pay all charges incurred by you or on your behalf through the Services, at the prices in effect when such charges are incurred. You will be responsible for paying all applicable taxes relating to your use of the Services.
You agree not to use the Website or Services to:
All content on the Website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Club de Padel or its content suppliers and protected by international copyright laws. The compilation of all content on this site is the exclusive property of Club de Padel and protected by international copyright laws.
The Website and Services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Club de Padel does not warrant that the Website will be uninterrupted or error-free, that defects will be corrected, or that the Website or the servers that make it available are free of viruses or other harmful components.
In no event shall Club de Padel, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
You agree to defend, indemnify, and hold harmless Club de Padel and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) content posted on the Service.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
12. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
13. Entire Agreement
These Terms, together with the Privacy Notice, constitute the entire agreement between you and Club de Padel regarding your use of the Website and Services, and supersede any prior agreements, whether written or oral.
